Throughout my service, intervals have occurred, aggregating nearly three years, and was this led to expect, not unreasonably, that through such lengthened intervals, and by four successive Governors, I might fairly look forward to succeed to the permanent appointment.
The Office of Chief Magistrate became vacant in 1836 by the promotion of the late Mr. Hillier; but was filled up at home by the appointment of Mr. Justice Davies, even before I became aware of the existence of the vacancy or had brought my claims under the consideration of the Secretary of State. I filled the acting appointment during that interval.
The office again became vacant in May 1856, and I then had the honor of addressing a letter to the Secretary of State, copy of which is enclosed, setting forth my claims. I was then officially recommended for it by the acting Governor, and, as it was not filled up for an entire year, during ten months of which I again filled the acting appointment; I fully assured myself that my claim to succeed to it had been at length recognized. I was doomed, however, to be again disappointed, for I learnt upon my arrival in this Country, in grievous ill health, that your Grace had been pleased to appoint Mr. F. C. Callaghan to the vacancy.
Again has the office become vacant, being the third time within five years, by the promotion of Mr. F. C. Callaghan to the Governorship of Labuan. The acting charge of it would again have devolved upon me, had not my health, already overworked and ill-requited, given way under prolonged Service.
